1. Acceptance of Terms
By accessing or using any service offered by Momo Cloud ("we", "us", or "our"), including our website at zepsoncloud.com and any related platforms, you ("Customer", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our services. These Terms apply to all users including individuals, companies, and organisations operating in the United Republic of Tanzania and beyond.
2. Services
Momo Cloud provides cloud-based hosting services including, but not limited to:
- Shared web hosting
- Virtual Private Servers (VPS)
- Dedicated servers
- Domain name registration and management
- Business email hosting
- WordPress-optimised hosting
- SSL/TLS certificates
We reserve the right to modify, suspend, or discontinue any service with reasonable advance notice (minimum 30 days for paid services, unless required otherwise by law or urgent security circumstances).
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@zepsoncloud.com if you suspect any unauthorised access.
Accounts must not be shared with third parties without our written consent. We may require identity verification for account creation or renewal.
4. Acceptable Use Policy (AUP)
You agree not to use our services to:
- Host, distribute, or transmit illegal content under Tanzanian or international law;
- Send unsolicited bulk email (spam) or operate open mail relays;
- Conduct phishing attacks, identity fraud, or social engineering;
- Engage in port scanning, network probing, or distributed denial-of-service (DDoS) attacks;
- Mine cryptocurrencies without our explicit written consent;
- Host content that infringes upon intellectual property rights;
- Distribute malware, ransomware, or any harmful software;
- Host child sexual abuse material (CSAM) or content that exploits minors in any way;
- Violate any applicable law or regulation.
Violation of this AUP may result in immediate suspension without refund. We cooperate fully with Tanzanian law enforcement and international authorities regarding illegal activity.
5. Billing, Payments & Refunds
All prices are listed in Tanzanian Shillings (TZS) unless otherwise stated. Payment is due at the start of each billing cycle. Accepted methods include mobile money (M-Pesa, Tigo Pesa, Airtel Money), credit/debit card, and other methods displayed at checkout.
Invoices are issued automatically and due within 7 days. Services may be suspended if an invoice remains unpaid after 7 days and terminated after 14 days of non-payment.
30-Day Money-Back Guarantee: New shared hosting, email hosting, and WordPress hosting accounts are eligible for a full refund if requested within 30 days of the initial order. This guarantee does not apply to domain registration fees, SSL certificates, VPS, dedicated servers, or renewal orders.
Refund requests must be submitted via the client portal or email to billing@zepsoncloud.com. Approved refunds are processed within 7 business days.
6. Service Level Agreement (SLA)
Momo Cloud targets 99.9% monthly uptime for shared hosting, VPS, and email services. This equates to a maximum of approximately 43 minutes of downtime per month.
Uptime is measured at the network edge. Scheduled maintenance windows (announced at least 48 hours in advance) are excluded from uptime calculations. Outages caused by factors outside our reasonable control (force majeure, DNS propagation, upstream provider issues, customer-side configuration errors) are also excluded.
If monthly uptime falls below 99.9%, customers may request a service credit of up to 10% of that month's fee. Credits are applied to the next invoice and are the sole remedy for downtime-related claims.
7. Suspension & Termination
We may suspend or terminate your account without prior notice if:
- You violate these Terms or the AUP;
- Your account is used for illegal activity;
- Payment is overdue by more than 14 days;
- We believe your account poses a security risk to our infrastructure or other customers.
You may terminate your account at any time from the client portal. Upon termination, you remain liable for any outstanding amounts.
We retain backups for a maximum of 30 days after account termination. After that period, data is permanently deleted. We strongly recommend maintaining your own independent backups at all times.
8. Intellectual Property
All content on the Momo Cloud website, including logos, branding, and software, is owned by or licensed to Momo Cloud. You retain ownership of any content you upload to your hosting account. By uploading content, you confirm you have the right to do so and grant us a limited licence to store and serve it as part of your service.
9. Limitation of Liability
To the maximum extent permitted by Tanzanian law, Momo Cloud shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to lost revenue, lost data, or business interruption.
Our total liability in any calendar month shall not exceed the amount you paid us during that month. We provide services "as is" and make no warranties beyond those expressly stated in these Terms.
10. Indemnification
You agree to indemnify and hold harmless Momo Cloud, its directors, employees, and agents from any claims, losses, or expenses (including legal fees) arising from your use of our services, your content, or your violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or a prominent notice on our website at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from or related to these Terms shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, disputes shall be submitted to the jurisdiction of the courts of the United Republic of Tanzania. Both parties waive any objection to the personal jurisdiction of Tanzanian courts.
